Terms of Service

In short: the free tier stays free for up to 20 students, you own your data and can export it any time, and you are responsible for having consent to message your students. The detail is below.

Agreement to these terms

These terms form an agreement between you and Libly. By creating an account or using the service you accept them. If you are accepting on behalf of a business, you confirm you have authority to bind that business.

If you do not agree with any part of these terms, do not use the service.

What Libly provides

Libly is software for running a study hall, reading room, coaching library or self-study centre. It manages students, seat and shift allocation, attendance, lockers, fees, receipts and automated reminders.

Libly is not an integrated library system. It does not provide book cataloguing, ISBN or MARC records, a public catalogue, or book lending and overdue-fine tracking. If you need those, Libly is not the right product for you.

Your account

  • You must give accurate registration information and keep it current.
  • You are responsible for keeping your password secure and for everything done under your account.
  • You must tell us promptly if you believe your account has been accessed without your permission.
  • One account is intended for one library business. Staff you invite work within your account under the permissions you assign them.
  • You must be at least 18 years old to hold an account.

Plans, billing and the free tier

  • The free tier supports up to 20 active students and is free indefinitely. We will not convert it to a paid plan without your explicit action.
  • Paid plans are quoted and charged in Indian Rupees and renew automatically for the billing period you chose until you cancel.
  • Prices may change. We will give you at least 30 days' notice before a change affects a renewal, and you may cancel before it takes effect.
  • Cancelling stops future renewals. Your paid features remain available until the end of the period you have already paid for.
  • Taxes, including GST where applicable, are charged in addition to the listed price unless stated otherwise.

Refunds

If a paid plan does not work for you, contact us within 7 days of the charge and we will refund it in full. After 7 days, payments for the current period are non-refundable, though you can still cancel to prevent the next renewal.

If we suspend or terminate your account for breaching these terms, no refund is due.

Your responsibilities for student data

You decide what student information to put into Libly, and you remain responsible for it. In data-protection terms you are the data fiduciary and Libly acts on your instructions.

  • You must have a lawful basis for collecting and storing the student details you enter, including phone numbers.
  • You must obtain the consent required by law before sending students automated WhatsApp or SMS reminders through Libly.
  • Where a student is under 18, you are responsible for obtaining parent or guardian consent.
  • You must respond to your own students' requests to access, correct or delete their records.

Acceptable use

You agree not to do any of the following.

  • Use Libly to send unsolicited marketing, spam or any message unrelated to the student's use of your library.
  • Upload malware, attempt to breach our security, or access another library's data.
  • Reverse engineer, resell, sublicense or white-label the service without our written permission.
  • Use the service for anything unlawful, or in a way that damages Libly's reputation or infrastructure.
  • Place automated load on the service beyond normal operation of a library.

Messaging and delivery

Libly sends reminders through third-party messaging networks, including WhatsApp. We cannot guarantee that any individual message is delivered, or delivered at a particular time, because delivery depends on the network, the recipient's device and their settings. You should not rely on an automated reminder as the only notice for something time-critical such as a payment deadline.

Availability

We work to keep Libly available and to schedule maintenance outside peak study hours, but we do not promise uninterrupted service and the free tier carries no uptime commitment. We may change or discontinue features. If we retire something you depend on, we will give reasonable notice where we can.

Your data and ownership

You own the data you put into Libly. We claim no ownership over your student records, fee history or reports. You may export your data at any time while your account is active.

We own the software, design and brand. These terms give you a licence to use the service, not any rights in it.

Affiliate and referral programmes

If you take part in our affiliate or referral programme, commissions are earned only on genuine paid signups from libraries you actually referred. Self-referrals, fabricated accounts and signups obtained through spam or misleading claims do not qualify, and we may withhold commissions and close programme access where we find abuse. Programme rates and rules may change with notice.

Limitation of liability

To the extent permitted by law, Libly is provided as is, without warranties of any kind. We are not liable for indirect or consequential losses, including lost revenue, lost students or lost data, arising from your use of the service.

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. If you are on the free tier, that amount is zero, which is a consequence of the service being free rather than an attempt to disclaim responsibility for the parts we do control.

Suspension and termination

You may stop using Libly and delete your account at any time. We may suspend or terminate your account if you materially breach these terms, if your use puts other customers or our infrastructure at risk, or if we are legally required to.

Where circumstances allow, we will warn you and give you a chance to fix the problem before terminating. After termination we handle your data as described in the Privacy Policy.

Governing law

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute. Before starting formal proceedings, please contact us — most problems are faster to resolve directly.

Changes to these terms

We may update these terms and will revise the date at the top when we do. For material changes we will give notice by email or in the app. Continuing to use Libly after a change takes effect means you accept the updated terms.
